BhoomiTrace Terms of Service

1. Acceptance of Terms & Eligibility

1.1 These Terms and Conditions of Use ("Terms") constitute a legally binding agreement between you and BhoomiTrace Analytics Private Limited("BhoomiTrace", "we", "us", "our").

1.2 You must be at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872 to use our Services. By creating an account or submitting information, you represent and warrant that you meet these eligibility criteria.

2. Nature of Services & Decision-Support

2.1 BhoomiTrace provides an AI-driven, evidence-led property decision-support platform designed to analyze land records, RERA information, title documents, builder profiles, and market data.

2.2 The Platform and its Reports, Risk Indicators ("Go", "Caution", "No-Go"), scores, and AI summaries are screening aids intended to assist user due diligence. They do not constitute legal title certificates, legal opinions, property valuations, or investment advice.

3. User Accounts, Security & Authentication

3.1 Account creation requires authentic contact details. You are responsible for maintaining the confidentiality of your login credentials, session tokens, and OTPs.

3.2 You must immediately notify BhoomiTrace of any unauthorized account access or security breach at support@bhoomitrace.com.

4. Acceptable Use & Prohibited Conduct

• Do not scrape, crawl, reverse engineer, or extract automated data from the Platform without express written authorization.
• Do not upload unlawful, fraudulent, altered, or unauthorized third-party documents.
• Do not attempt to bypass rate limits, authentication controls, or payment mechanisms.
• Do not submit unredacted sensitive identifiers like passwords, card CVVs, or full Aadhaar numbers.

5. User Inputs & Uploaded Documents

5.1 You retain ownership of documents and inputs you upload. By submitting inputs, you grant BhoomiTrace a non-exclusive, worldwide, royalty-free license to process, extract, standardise, and analyze the content solely to provide requested Services and improve system accuracy.

5.2 Raw uploaded documents are stored for up to 90 days after Report generation, unless you explicitly select long-term storage features.

6. Intellectual Property Rights

All software, proprietary algorithms, Risk Indicator methodologies, branding, UI designs, and compiled analytics are the exclusive intellectual property of BhoomiTrace Analytics Private Limited.

7. Fees, Payments, Subscriptions & Refunds

7.1 Paid report plans, subscription tiers, and premium analysis features are billed via secure third-party payment gateways. All prices are stated in INR inclusive of applicable taxes.

7.2 Fees paid for completed reports are generally non-refundable once report generation has commenced, unless a technical error prevents report delivery.

8. Third-Party Services, Partners & Referrals

Referrals to third-party lenders, brokers, lawyers, or valuers are optional. BhoomiTrace is not responsible for third-party loan decisions, legal opinions, or professional services.

9. Disclaimers & Limitation of Liability

To the maximum extent permitted by Indian law, BhoomiTrace's total aggregate liability for any claim shall not exceed the amount paid by you for the specific Service in question.

10. Indemnification

You agree to indemnify and hold harmless BhoomiTrace, its directors, officers, and employees from any claims arising out of your violation of these Terms or unauthorized document uploads.

11. Termination & Account Suspension

We reserve the right to suspend or terminate accounts that breach these Terms, engage in fraudulent activity, or misuse automated extraction tools.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Courts in Jaipur, Rajasthan shall have exclusive jurisdiction over any legal proceedings arising from these Terms or use of the Services.
